2. Acceptance of Terms
By creating or maintaining an account with Hosting.ca, you agree to comply with these Terms and Conditions and all associated policies, including the Service Level Agreement, Billing Policy, WordPress Hosting Policy, and No Spam Policy.
3. Illegal Use
Hosting.ca services may be used for lawful purposes only. Transmission, distribution, or storage of illegal, obscene, defamatory, or infringing material is strictly prohibited.
4. Security
Unauthorized access, probing, or denial-of-service activity is prohibited and may lead to suspension or legal action.
Customers are required to maintain secure passwords and properly configure their systems.
5. Server Resources
Accounts using excessive CPU, memory, or bandwidth may be suspended or billed additional fees. Hosting.ca reserves the right to determine what constitutes excessive use.
6. Software and Scripts
Unsupported or resource-intensive applications, background processes, or outdated code may be disabled without notice if they threaten server stability or security.
7. Unsolicited Commercial Email (Spam)
Hosting.ca enforces a zero-tolerance policy for spam. Sending unsolicited or bulk email, or using external mail servers to promote a hosted domain, is prohibited. See our No Spam Policy for full details.
8. Actions Taken by Hosting.ca
Hosting.ca may restrict, suspend, or terminate service for violations. Investigative or cleanup labour is billed at $150 CAD/hour when applicable.
9. Limitation of Liability
Hosting.ca’s total cumulative liability shall not exceed fees paid for the affected service period. Hosting.ca shall not be liable for indirect or consequential damages, including loss of data, revenue, or business.
10. Warranty by Hosting.ca
Hosting.ca warrants that services will be performed in a professional manner. All other warranties are disclaimed.
Warranty Scope Clarification
Hosting.ca’s warranties cover infrastructure, hardware, and network connectivity only. Application functionality (WordPress, Joomla, Drupal, etc.) remains the customer’s responsibility. Assistance is billed at the current rate of $150 CAD/hour, in 30-minute increments.
11. Governing Law and Jurisdiction
This Agreement, and all related Hosting.ca policies — including the Service Level Agreement, Billing Policy, WordPress Hosting Maintenance Policy, and No Spam Policy — shall be governed by and interpreted in accordance with the laws of the Province of British Columbia, Canada.
Any claim, dispute, or proceeding arising from Hosting.ca’s services shall be resolved exclusively in the provincial courts located in British Columbia, Canada.
By using Hosting.ca’s services, the Customer irrevocably consents to the jurisdiction and venue of such courts and waives any objection based on inconvenient forum or jurisdiction.
12. Force Majeure
Neither party shall be liable for failure or delay due to causes beyond reasonable control.
13. Entire Agreement and Modification
This document represents the entire agreement between the Customer and Hosting.ca. Hosting.ca may modify it at any time without notice.
